This TASFRL Website User Agreement (“Agreement”) governs your use of the Texas AgriForestry Small Farmers, Ranchers, and Landowners (“TASFRL,” “we,” or “our”) website, membership portal, programs, and services. By accessing this website, creating a membership account, or submitting a service request, you acknowledge and agree to the terms below.
TASFRL may collect the following types of information:
Personal Information: Your name, contact information, demographic data voluntarily provided, and membership details.
Landowner/Client Information: Property location, GPS/GIS data, photos, videos, drone imagery, service requests, and field notes.
Financial Information: Payment and billing information for transactions or donations.
Technical Information: IP address, browser/device type, website usage logs, security logs.
Voluntary Submissions: Surveys, program participation information, and other materials you choose to provide.
Your information is used only for legitimate nonprofit purposes, including:
Membership administration and communication
Scheduling, coordinating, and delivering TASFRL services and field activities
Program delivery, technical assistance, education, and outreach
Grant compliance and reporting (anonymized when possible)
Internal evaluation and organizational planning
Safety, risk management, and legal compliance
Recordkeeping consistent with TASFRL’s Bylaws, Confidentiality Policy, and Document Retention Policy

TASFRL does not and will not sell, rent, or trade any personal, membership, donor, or service-related information.
No customer data will ever be sold.
TASFRL personnel, contractors, volunteers, and board members are required to:
Maintain confidentiality

For service delivery (e.g., contractors supporting TASFRL field operations)

If you request field-based work, you consent that:
TASFRL personnel and contractors may enter your property

You will disclose hazards, utilities, livestock, restricted areas, or sensitive features
Imagery will not be published or disclosed without your explicit permission unless required by law.
Participation in TASFRL programs or services may require additional written agreements. By engaging with TASFRL, you agree to comply with all such requirements.
By clicking “I Agree,” you provide legally binding consent under the Texas Uniform Electronic Transactions Act (UETA).
TASFRL provides education, technical assistance, outreach, and land/forestry-related services in good faith. However, TASFRL does not guarantee specific land, forestry, agricultural, or financial outcomes.
Unless expressly stated in writing, TASFRL does not provide:
Legal
Tax
Engineering
Surveying
Accounting
Financial advisory services
Users must consult licensed professionals for such matters.
By requesting field operations (e.g., brush mulching, clearing, excavation, drone flights), you acknowledge:
These activities carry inherent risks
You must stay away from active work zones
You must follow TASFRL staff instructions
You must disclose hazards, restricted areas, protected habitats, or utilities
You authorize TASFRL personnel and contractors to enter designated portions of your property as necessary to deliver services.
To the fullest extent permitted by Texas law—including the Texas Charitable Immunity and Liability Act (Tex. Civ. Prac. & Rem. Code §84) and the Texas Business Organizations Code Chapter 22—TASFRL, its board members, officers, employees, contractors, and volunteers are not liable for:
Indirect, incidental, special, or consequential damages
Damages arising from conditions beyond TASFRL’s control
Damages caused by inaccurate or incomplete information provided by the user
Weather, natural events, wildlife, or unknown property conditions
This aligns with Article XI (Indemnification) of the TASFRL Bylaws.

You agree to:
Provide accurate information
Maintain safe distance during field operations
Follow TASFRL instructions and safety requirements
Identify known hazards, utilities, or restricted areas
Provide reasonable access to work zones
By selecting “I Agree,” you acknowledge:
You have read and understand this Agreement
You accept all terms in Sections A, B, and C
Your acceptance forms a legally binding contract under Texas UETA
Your use of TASFRL’s website, programs, and services is voluntary and conditioned on acceptance of this Agreement
