This Liability Statement applies to all TASFRL website visitors, members, clients, and individuals requesting or receiving TASFRL services or participating in TASFRL programs.
TASFRL provides educational services, technical assistance, resource guidance, and land/forestry support in good faith and in alignment with our Bylaws, Code of Ethics, and operating standards. However:
TASFRL does not warrant or guarantee specific outcomes, financial results, or land performance, as land management inherently involves variable and unpredictable factors (weather, climate, market conditions, soil conditions, pests, regulatory changes, etc.).
Unless explicitly stated in writing, TASFRL does not provide professional legal, tax, engineering, surveying, or financial advisory services. Individuals should consult licensed professionals for decisions requiring such expertise.
By requesting field services (e.g., brush clearing, mulching, excavation, forestry operations, drone flights), you acknowledge:
Such activities involve inherent risks, including mechanical hazards, terrain issues, weather conditions, and natural obstacles
You must stay clear of equipment zones and follow all TASFRL staff instructions
You are responsible for notifying TASFRL of known hazards, underground utilities, protected habitats, or sensitive features
You authorize TASFRL staff, volunteers, and contractors to enter your property for purposes necessary to deliver the requested services.
To the fullest extent permitted by Texas law (Texas Civil Practice & Remedies Code §84; Texas BOC Chapter 22), TASFRL, its Board of Directors, officers, employees, volunteers, and contractors shall not be liable for:
Indirect, incidental, consequential, punitive, or special damages
Damages arising from conditions outside TASFRL’s control
Losses resulting from inaccurate, incomplete, or withheld information provided by the client
Damages arising from weather, natural events, wildlife, or unknown property conditions
This protection is consistent with Article XI (Indemnification) of the TASFRL Bylaws.
